Terms and Conditions for Copyable

IMPORTANT NOTICE: These Terms and Conditions (the "Terms") constitute a legally binding agreement between you (the "User") and the Developer concerning the Copyable application (the "App"). By downloading, installing, or using the App, you signify your agreement to these Terms.

1. Service and Usage License

  • Limited License: The Developer grants you a non-exclusive, non-transferable, limited license to use the App and all its features and content, strictly for personal, non-commercial purposes.
  • Non-Medical Disclaimer: The User expressly acknowledges and agrees that the functions provided by the App are intended for productivity and personal aid purposes only. The Developer is not liable for any outcomes based on the use of the App.

2. Use Restrictions and Prohibited Conduct

Your permission to use the Service is conditioned upon your agreement that you will not:

  • Unauthorized Access: Access, tamper with, or use any non-public code, systems, or data of the App without authorization.
  • Interference: Interfere or attempt to interfere with the proper functioning, security, or network of the App.
  • Automated Misuse: Engage in automated use of the App (e.g., using bots, spiders, or data mining tools), or take any action that we deem to impose or potentially impose an unreasonably large load on our systems.
  • Legal Compliance: Use the App in any manner that violates applicable laws or regulations.

3. Intellectual Property and Content Ownership

  • Developer Ownership: The Developer retains all right, title, and interest in and to the App, including all proprietary content, features, design, source code, graphics, and all related intellectual property rights ("App Content").
  • Prohibition on Reproduction: You may not copy, modify, translate, reverse-engineer, decompile, disassemble, or create derivative works of the App or the App Content.

4. Free Trial and One-Time Purchase

The App offers a full-featured free trial period of thirty (30) days ("Trial Period").

  • Trial Period: The Trial Period begins when you first start using the App and lasts for thirty (30) consecutive days.
  • Expiration of Trial: Upon the expiration of the Trial Period, the App will require a valid license key to continue functioning.
  • One-Time Purchase: You can upgrade to the full version through a single, non-recurring payment ("One-Time Purchase"). This purchase grants you a perpetual license for the current major version of the App.
  • Payment Provider: All transactions for the One-Time Purchase are handled by Gumroad. By making a purchase, you also agree to Gumroad's terms and conditions.
  • Refund Policy: Due to the nature of digital products, all sales are generally final and non-refundable once the file has been accessed or the license activated, except as required by law or specified in our separate Refund Policy.

5. Limitation of Liability

The Developer's total liability to you for all damages shall be limited as provided in Section 9 below.

6. Indemnification

You agree to defend, indemnify, and hold harmless the Developer from and against all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use or misuse of the App or your breach of these Terms.

7. Privacy Policy

The Developer has published a separate Privacy Policy, which details how the Developer collects (e.g., hardware ID for license verification), uses, and protects user data. Your use of the App signifies your agreement to the Privacy Policy.

8. External Services

The App may provide links to third-party services. You agree to use any external services at your sole risk. The Developer has no control over and is not responsible for the content or security of any third-party services.

9. NO WARRANTY & LIMITATION OF LIABILITY

  • DISCLAIMER: YOUR USE OF THE APP IS AT YOUR SOLE RISK. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The Developer expressly disclaims all warranties, express or implied.
  • LIMITATION OF LIABILITY: To the extent not prohibited by law, the Developer shall not be liable for any indirect, incidental, special, or consequential damages. The Developer's total liability to you shall not exceed the amount of fifty dollars ($50.00).

10. General Provisions

  • 10.1 Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and the Developer.
  • 10.2 Severability: If any part of these Terms is deemed invalid, the remainder shall remain in full force and effect.

11. Changes to Terms

The Developer reserves the right to modify these Terms at any time. Revised Terms will be effective immediately upon posting. Your continued use of the App constitutes acceptance of the revised Terms.
